Terms of Service

By accessing, browsing, or using the Dwell Finders website and mobile application (collectively, the "Platform"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service ("Terms"). These Terms constitute a legally binding agreement between you and TechFusion Ltd, the company operating Dwell Finders.

If you do not agree to these Terms, you must immediately discontinue use of the Platform. These Terms are governed by the laws of the Republic of Ghana, including the Electronic Transactions Act, 2008 (Act 772) and the Data Protection Act, 2012 (Act 843).

• "Platform" refers to the Dwell Finders website, mobile application, and all associated services.
• "User" refers to any individual who accesses or uses the Platform, including property seekers, property owners, and agents.
• "Agent" refers to a licensed or registered real estate agent who lists properties on the Platform.
• "Property Owner" refers to a person or entity that lists property for sale or rent on the Platform.
• "Content" refers to all text, images, data, listings, communications, and other materials on the Platform.
• "Services" refers to the property listing, searching, messaging, tour scheduling, and related features provided by the Platform.

To use the Platform, you must:

• Be at least 18 years of age or the age of legal majority in your jurisdiction.
• Have the legal capacity to enter into binding agreements under Ghanaian law.
• Provide accurate, current, and complete information during registration.
• Not have been previously suspended or removed from the Platform.

4.1 Account Registration

You are required to create an account to access certain features of the Platform. You agree to provide truthful, accurate, and complete registration information and to keep this information up to date.

4.2 Account Security

You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.

4.3 Account Termination

We reserve the right to suspend or terminate your account at our discretion if you:

• Violate any provision of these Terms.
• Provide false or misleading information.
• Engage in fraudulent or illegal activity.
• Harass, threaten, or harm other users.

If you list a property on the Platform as an agent or property owner, you represent and warrant that:

• You have the legal right and authority to list the property for sale or rent.
• All information provided about the property is accurate, truthful, and not misleading.
• All images and media are genuine representations of the property.
• The listing complies with all applicable Ghanaian laws, including the Rent Act, 1963 (Act 220) and the Land Title Registration Act, 1986 (PNDCL 152).
• You will promptly update or remove listings that are no longer available.

Dwell Finders reserves the right to review, edit, or remove any listing that violates these Terms or applicable law, without prior notice.

You agree not to:

• Use the Platform for any unlawful purpose or in violation of any applicable Ghanaian or international law.
• Post false, misleading, or fraudulent property listings.
• Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
• Harass, abuse, or threaten other users through the Platform's messaging system.
• Distribute viruses, malware, or any other harmful code through the Platform.
• Attempt to gain unauthorized access to other user accounts, our servers, or our databases.
• Interfere with or disrupt the Platform's operation, servers, or networks.
• Use the Platform to collect personal information about other users without their consent.
• Circumvent, disable, or otherwise interfere with any security-related features of the Platform.

You are strictly prohibited from using any automated means to access, scrape, crawl, harvest, or extract data from the Dwell Finders Platform. This includes but is not limited to:

• Using bots, spiders, crawlers, scrapers, or any other automated tools or software to access or collect data from the Platform.
• Systematically downloading, copying, or re-publishing property listings, user profiles, images, or any other Content.
• Creating derivative databases or datasets from data obtained from the Platform.
• Using data mining, robots, or similar data gathering and extraction methods on the Platform.
• Accessing the Platform through any automated means at a rate that exceeds what a reasonable person could achieve manually.

Violation of this section may result in immediate account termination, IP blocking, and legal action under the Electronic Transactions Act, 2008 (Act 772), the Copyright Act, 2005 (Act 690), and any other applicable Ghanaian or international legislation. We actively monitor for automated access and will pursue all available remedies.

All content on the Platform, including but not limited to text, graphics, logos, icons, images, software code, and compiled data, is the property of Dwell Finders or its licensors and is protected by Ghanaian and international copyright, trademark, and intellectual property laws, including the Copyright Act, 2005 (Act 690) and the Trademarks Act, 2004 (Act 664).

User-submitted content (such as property listings and images) remains the property of the respective user. By submitting content, you grant us a non-exclusive, worldwide, royalty-free licence to use, display, reproduce, and distribute such content solely for the purpose of operating and promoting the Platform.

The Platform may contain links to third-party websites or services (e.g., payment processors, mapping services). Dwell Finders is not responsible for the content, privacy practices, or terms of any third-party services. Your use of such services is at your own risk and subject to their respective terms and policies.

Certain features of the Platform may involve payments or voluntary donations. All financial transactions are processed through secure third-party payment providers (e.g., PayPal). We do not store your payment card details on our servers.

All payments and donations are final unless otherwise stated. Refund requests will be handled on a case-by-case basis in accordance with applicable Ghanaian consumer protection laws.

The Platform is provided on an "as is" and "as available" basis. Dwell Finders makes no warranties, express or implied, regarding:

• The accuracy, completeness, or reliability of any property listings or user-submitted content.
• The suitability, safety, or legality of any listed properties.
• The identity, credentials, or trustworthiness of any users, agents, or property owners.
• Uninterrupted, error-free, or secure access to the Platform.

To the maximum extent permitted by Ghanaian law, Dwell Finders and its directors, officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or relating to your use of the Platform, including but not limited to property transactions, loss of data, loss of profits, or personal injury. Our total liability for any claims arising under these Terms shall not exceed the amount you have paid to us in the preceding twelve (12) months.

You agree to indemnify, defend, and hold harmless Dwell Finders, TechFusion Ltd, and their respective directors, officers, employees, and agents from and against any and all claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of or relating to your use of the Platform, your violation of these Terms, or your violation of any rights of a third party.

Dwell Finders may suspend or terminate your access to the Platform at any time, with or without cause, and with or without notice. Upon termination, your right to use the Platform ceases immediately.

Provisions of these Terms that by their nature should survive termination (including sections on intellectual property, limitation of liability, indemnification, and governing law) shall survive.

These Terms shall be governed by and construed in accordance with the laws of the Republic of Ghana, without regard to conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Ghana.

Before commencing any legal proceedings, the parties agree to attempt to resolve any dispute through good-faith negotiation for a period of not less than thirty (30) days. If the dispute cannot be resolved through negotiation, either party may submit the matter to arbitration under the Alternative Dispute Resolution Act, 2010 (Act 798).

Dwell Finders reserves the right to modify these Terms at any time. Material changes will be communicated through the Platform or via email. Your continued use of the Platform following any changes constitutes your acceptance of the revised Terms.
